Case No. PB-2016-137 COMBINED NOTICE TO CREDITORS AND NOTICE OF HEARING To: All persons interest in the Estate of Harold Dean Lusk, Deceased You are hereby notified that on the September 28, 2016, the Petitioner, Mary Ada Lusk, filed in the District Court of Pittsburg County a Petition for Summary Administration, and Appointment of Special Administrator. The Petitioner has alleged that: (a) Harold Dean Lusk, Deceased, of legal age, died intestate on August 11, 2016, domiciled in and residing in Pittsburg County, State of Oklahoma; (b) Petitioner Mary Ada Lusk is the wife of the Decedent; (c) The name and address of the heirs or devisees are: Mary Ada Lusk, PO Box 173, Indianola, OK 74442, Jeffery Lynn Lusk, PO Box 173, Indianola, OK 74442, Jerry John Lusk, 9 Gale Lane, Sapulpa, OK 74066, Janet Dean Johnson, PO Box 294, Sapulpa, OK 74066; and (c) that the total value of the Decedentâs property in Oklahoma is $38,434.00. Petitioner has asked this Court for other summary proceedings pursuant to 58 O.S. 245, et seq. In an Order for Combined Notice entered on September 28th, 2016, the Court found that it should dispense with the regular estate proceedings prescribed by law and order notice to creditors and issue an order for hearing upon the Petition for Summary Administration, the final accounting, and petition for determination of heirs, and distribution. Pursuant to the Order for Combined Notice, all creditors having claims against Harold Dean Lusk, Deceased, are required to present the same with a description of all security interests and other collateral (if any) held by each creditor with respect to such claim, to Mary Ada Lusk, Personal Representative, c/o Brett Cable, Cable Law, PLLC, 438 E. Carl Albert Pkwy., McAlester, OK 74501-4913, attorney for the Personal Representative, on or before the following presentment date: November 2, 2016, or the same will be forever barred. Notice is also hereby given that a hearing will be held on the November 30, 2016, at 2:30 oâclock p.m. at the Pittsburg County Courthouse, Courtroom #4, 115 E. Carl Albert Pkwy, before Judge Hogan. At the hearing the Court will decide whether to approve the Petition for Summary Administration and the final account and petition for determination of heirs, and distribution of the Petitioner. The final account and petition for determination of heirs, and distribution will be filed herein on or before November 9, 2016. You are hereby advised that you must file objections to the Petition for Summary Administration and the final account and petition for determination of heirs, and distribution at least ten (10) days before the hearing and send a copy to the Petitioner in care of her attorney, or you will be deemed to have waived any objections. If you have no objections, you need not appear at the hearing or make any filings with the Court. If an objection is filed at least ten (10) days before the hearing, the Court will determine at the hearing whether summary proceedings are appropriate and, if so, whether the estate will be distributed and to whom the estate will be distributed.
