BEFORE THE CORPORATION COMMISSION OF THE STATE OF OKLAHOMA APPLICANT: BP AMERICA PRODUCTION COMPANY RELIEF SOUGHT: LOCATION EXCEPTION LEGAL DESCRIPTION: Section 8, Township 3 North, Range 12 East of the IM, Pittsburg County, Oklahoma Cause CD No. 201603240 NOTICE OF HEARING STATE OF OKLAHOMA TO: All persons, owners, producers, operators, purchasers and takers of oil and gas, and all other interested persons, particularly in Pittsburg County, Oklahoma, including the following: Bravo Arkoma, LLC; Cimarex Energy Company; CoLa Resources, LLC; Dean R. Mabray; Diamond Offshore Drilling, Inc.; Fluor Drilling Services, Inc.; England Resources Corporation; Jerri Mabray; Joseph Morelli, a/k/a Joseph J. Morelli; Kaiser-Francis Oil Company; Princeton Energy, LLC; Richard Lewisohn III; Toklan Oil and Gas Corporation; Vanguard Operating, LLC; Vanguard Permian, LLC; XTO Energy, Inc.; Kaiser-Francis Mid-Continent Limited Partnership; if any of the above-named individuals be deceased, then the unknown heirs, executors, administrators, devisees, trustees and assigns, both immediate and remote, of such deceased individual; and if any of the above-named parties is a dissolved partnership, corporation or other association, then the unknown successors, trustees and assigns, both immediate and remote, of such dissolved entity. NOTICE IS HEREBY GIVEN that Applicant, BP America Production Company, has filed an application in this cause requesting the Corporation Commission of Oklahoma to enter an order, to be effective as of the date of the execution thereof or as of a date prior thereto, as follows: (i) authorizing and permitting an exception to the permitted well location tolerances in the 640-acre drilling and spacing units formed in Section 8, Township 3 North, Range 12 East of the IM, Pittsburg County, Oklahoma, for the Mississippian, Woodford and Hunton separate common sources of supply, so as to allow a well to be drilled into, to be completed in and to produce hydrocarbons from such separate common sources of supply, with the subsurface locations of such well in the separate common sources of supply involved herein, including the completion interval in the lateral of such well, to be located within the subsurface location tolerance area as set forth below: not closer than 165 feet from the north line and not closer than 330 feet from the east line and not closer than 330 feet from the west line and not closer than 165 feet from the south line of said Section 8, and with such authorization and permission running in favor of Applicant, or some other party recommended by Applicant; and (ii) establishing a proper allowable for the proposed well involved herein as to the separate common sources of supply covered hereby, which allowable Applicant requests be established as a full allowable with no downward adjustment made thereto. NOTICE IS HEREBY GIVEN that the application in this cause requests that the order to be entered in this matter be made effective as of the date of the execution thereof or as of a date prior thereto and that the authorization and permission requested herein run in favor of Applicant, or some other party recommended by Applicant. NOTICE IS FURTHER GIVEN that the "land sections adjacent to the area within the location exception" requested herein in said Section 8 in regard to the subsurface location tolerance area for the proposed well covered hereby, as described above, are Sections 4, 5, 6, 7, 9, 16, 17 and 18, Township 3 North, Range 12 East of the IM, Pittsburg County, Oklahoma. There is no other “land sections” surrounding said Section 8. NOTICE IS FURTHER GIVEN that this cause is set before an administrative law judge for hearing, taking of evidence and reporting to the Corporation Commission of Oklahoma. Notice is further given that the application in this cause may be amended at such hearing in accordance with the rules of the Commission and the laws of the State of Oklahoma. NOTICE IS FURTHER GIVEN that this cause is set for hearing before an administrative law judge on the Conservation Docket at the Western Regional Service Office of the Corporation Commission, Jim Thorpe Building, 2101 North Lincoln Boulevard, Oklahoma City, Oklahoma, at 8:30 A.M. on the 30th day of August, 2016, and that this notice be published as required by law and the rules of the Commission. NOTICE IS FURTHER GIVEN that Applicant and interested parties may present testimony by telephone. The cost of telephonic communication shall be paid by the person or persons requesting its use. Interested parties who wish to participate by telephone shall contact Applicant or Applicant's attorney, prior to the hearing date, and provide their names and telephone numbers.
