SOLICITATION FOR BIDS Notice is hereby given that the City of McAlester will receive sealed bids, at the office of the City Clerk, Municipal Building, 28 East Washington, McAlester, Oklahoma 74501, until 10:30 A.M. on Thursday the 11th day of August 2016, said bids will be opened at that time for: Install New Rotating Beacon AIP Project 3-40-0057-014-2016 McAlester Regional Airport Bids shall be made in accordance with the Solicitation for Bids, Information for Bidders, Plans, Specifications and Bidder's Proposal, which are on file and available for examination at the office of the City Clerk, Municipal Building, 28 East Washington, McAlester, Oklahoma, and are made a part of this notice as though fully set forth herein. Plans and specifications may be purchased for $100.00 from LBR Inc., 1802 W Wright Drive, Stillwater, Oklahoma 74075, Telephone 405/377-8276. Payment shall be by cash or check made payable to LBR Inc. Plan purchases are non-refundable. Bids filed with the City Clerk shall be publicly opened and considered at the time stated above. All bids shall remain on file at least forty-eight (48) hours thereafter before a contract shall be made and entered into thereon. Bids received more than ninety-six (96) hours, excluding Saturdays, Sundays, and holidays, before the time set for opening of bids, as well as bids received after the time set for opening of bids, will not be considered and will be returned unopened. The value of this project exceeds one hundred thousand dollars ($100,000.00). Accordingly, the FAA has determined that the contract is subject to and shall contain provisions mandating contractor compliance with the following federal statutes, rules, regulations, and/or orders: Buy American Preference - Title 49 U.S.C., Chapter 501 Civil Rights Act of 1964, Title VI - Contractor Contractual Requirements - 49 CFR Part 21 Airport and Airway Improvement Act of 1982, Section 520 - Title 49 U.S.C. 47123 Lobbying and Influencing Federal Employees - 49 CFR Part 20 Access to Records and Reports - 49 CFR Part 18.36 Disadvantaged Business Enterprise - 49 CFR Part 26 Energy Conservation - 49 CFR Part 18.36 Breach of Contract Terms - 49 CFR Part 18.36 Rights to Inventions - 49 CFR Part 18.36 Trade Restriction Clause - 49 CFR Part 30 Veteran's Preference - Title 49 U.S.C 47112 Davis Bacon Labor Provisions - 29 CFR Part 5 Equal Opportunity Clause - 41 CFR Part 60-1.4 Certification of Non-Segregated Facilities - 41 CFR Part 60-1.8 Notice of Requirement for Affirmative Action - 41 CFR Part 60-4.2 Equal Employment Opportunity Specification - 41 CFR Part 60-4.3 Termination of Contract - 49 CFR Part 18.36 Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion - 49 CFR Part 29 Contract Workhours and Safety Standards Act Requirements - 29 CFR Part 5 Clean Air and Water Pollution Control - 49 CFR Part 18.36(i) (12) Bidders are directed to familiarize themselves with these provisions prior to submitting a bid in response to this solicitation. All bidders shall make good faith effort, as defined in Appendix A of 49 CFR Part 26, Regulations of the Office of the Secretary of Transportation, to subcontract (NO DBE GOAL THIS PROJECT) of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). In the event the bidder for this solicitation qualifies as a DBE, the contract goal shall be deemed to have been met. Individuals who are rebuttably presumed to be socially and economically disadvantaged include women, Blacks, Hispanics, Native Americans, Asian-Pacific Americans and Asian-Indian Americans. The apparent successful bidder will be required to submit the following information concerning DBE's: (i) the name and address of each DBE that will participate in the contract; (ii) a description of the work that each DBE will perform; (iii) the dollar amount of the participation of each DBE participating; (iv) written documentation of the bidders commitment to use a DBE subcontractor whose participation it submits to meet a contract goal; (v) written confirmation from the DBE that it is participating in the contract as provided in the prime contractor’s commitment; and (vi) if the contract goal is not met, evidence of good faith efforts. A cashier's check, a certified check, a surety bond or an irrevocable letter of credit in the amount of five percent (5%) of the bid shall accompany the sealed proposal of each bidder. Deposits will be returned to the unsuccessful bidders. The City of McAlester reserves the right to reject any and all bids and to waive any or all bids and to waive any and all informalities. Upon receipt of an acceptable bid, the contract will be awarded within one hundred twenty (120) days after opening of bids and the written contract executed within ten (10) days thereafter. There will be a pre-bid conference concerning this project at 10:30 A.M., Tuesday, August 2, 2016, in the Terminal Building, McAlester Regional Airport, McAlester, Oklahoma. Attendance at the Pre-Bid Conference is MANDATORY. Bids will NOT be accepted from contractors who do NOT have a representative attending the Pre-Bid Conference. No plans, specifications or bid documents will be issued after the Pre-Bid Conference.
