ORDINANCE No. 16-01A AN ORDINANCE ADDING ADDENDUM ‘A’ TO THE KREBS, OKLAHOMA ORDINANCE 16-01 NUISANCE CODE CHAPTER 13 ARTICLE 1 SECTION 13-11B. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KREBS, THE COUNTY OF PITTSBURG, AND THE STATE OF OKLAHOMA. Chapter 13 Article 1 Section 13-11. Notice, hearing, and abatement. B. This notice shall order the property owner to clean the property of trash, or to cut or mow weeds or grass on the property, as appropriate, and such notice shall further state that unless such work is performed within ten (10) days from the date of the notice. Failure to do so shall be considered an offense. The Property Owner will receive a notice of non-compliance in the form of a written ticket for the offense which will be a monetary fine of $100.00 (one hundred dollars) and a Second (2nd) Notice of non-compliance that will require action within 10 days from the date of the second (2nd) notice to clean trash, mow grass or weeds, as appropriate. Failure to do so will constitute a separate offense to be addressed in the form of a written ticket with a monetary fine in the amount of $200.00 (two hundred dollars) and a Third (3rd) Notice of non-compliance that will require action within 10 days from the date of the third (3rd) notice to clean trash, mow grass or weeds, as appropriate. Failure to do so will constitute a separate offense. If at the end of the 30 day extensions, the issue is unresolved, the work shall be done by the City of Krebs and a Notice of Lien shall be filed with the Pittsburg County Clerk against the property for any and all costs due and owing to the City of Krebs. At the time of mailing of notice to the property owner, the city shall obtain a receipt of mailing from the postal service, which receipt shall indicate the date of the mailing and the name and address of the intended recipient. EMERGENCY CLAUSE: It being immediately necessary for the preservation of the public peace, health and safety, and emergency is hereby declared to exist by reason of which this ordinance shall take effect and be in full force and effect from and after its passage, approval and publication.
