CJ-2015-105 JUDGE MILLS, TIM NOTICE OF ALIAS SALE OF LAND UNDER EXECUTION THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Notice is hereby given that on the 5th day of May, 2016, at 10 o'clock, A.M., Front Lobby, of the Pittsburg County Courthouse in McAlester, Oklahoma, the undersigned Sheriff will offer for sale and sell for cash to the highest and best bidder, subject to real estate ad valorem taxes, superior special assessments and all interests of record, if any, except the Mortgage and interests foreclosed herein on the following described real property, to-wit: TRACT 1: A tract of land in Lot Eighty-six (86), TOWNSITE ADDITION NO. 13, Pittsburg County, State of Oklahoma, more particularly described as follows: Beginning at the Northeast corner of Lot Eighty-six (86), at a stone for a corner; thence N 89°44' W a distance of 635 feet for the true point of beginning, thence N 89°44' W a distance of 150 feet; thence South a distance of 242.5 feet to the North right-of-way line of U.S. Highway No. 270; thence S 76°01' E along the North right-of-way line of Highway No. 270, a distance of 154.6 feet; thence North and parallel with the East line of Lot Eighty-six (86) a distance of 279.8 feet to the true point of beginning, less and except the Northerly 20 feet thereof; AND Tract 2: a Tract of land in Lot Eighty-six (86), TOWNSITE ADDITION NO. 13, Pittsburg County, Oklahoma, more particularly described as follows: Beginning at the Northeast corner of Lot Eighty-six (86); thence South along the East line of said Lot Eighty-six (86) a distance of 428.9 feet; thence Northwesterly along the North right of way line of Old Highway No. 270 a distance of 809.1 feet for the true point of beginning; thence North and parallel with the West line of said Lot Eighty-six (86) a distance of 242.5 feet; thence Westerly along the North line of said Lot 86 a distance of 22 feet; thence Southeasterly in a straight line a distance of 243.5 feet for the true point of beginning, according to the U.S. Government Survey thereof, commonly known as 939 Old 270 West, McAlester, OK 74501 (the "Property") Sale will be made pursuant to a Special Execution and Order of Sale issued out of the office of the Court Clerk in and for Pittsburg County, Oklahoma, and pursuant to said judgment reserving the right of Plaintiff to recall said execution by oral announcement and/or order of the Court, prior to the sale, said judgment entered in the District Court in and for said County, State of Oklahoma, in Case No. CJ-2015-105, entitled JPMorgan Chase Bank, National Association, Plaintiff, vs Ethan D. Brown; Hailey Brown, et al., Defendants, to satisfy: FIRST: The costs of said action accrued and accruing; SECOND: The judgment and first lien of the Plaintiff, JPMorgan Chase Bank, National Association, in the sum of $95,613.14 with interest thereon at the rate of 3.25% per annum from October 1st, 2014, as adjusted, if applicable, until paid; advances for taxes, insurance and preservation expenses, accrued and accruing; abstracting expenses, accrued and accruing; bankruptcy fees and costs, if any; and an attorney¹s fee, plus costs, with interest thereon at the same rate, until paid. Persons or other entities having interest in the property, including those whose actual addresses are unknown and persons or other entities who have or may have unknown successors and such unknown successors are hereby notified are: Ethan D. Brown; Hailey Brown; Spouse of Ethan D. Brown, if married; Spouse of Hailey Brown, if married, Occupants of the Premises. The property has been duly appraised in the sum of $87,500.00.
